CONDITIONS OF PARTICIPATION
for NESTEA® "Crazy Calculator"

TERMS AND CONDITIONS

The NESTEA® “Crazy Calculator” is open to all residents, excluding employees and their immediate families of Beverage Partners Worldwide (Europe) A.G. (“BPW”) [Local markets to add local TCCC entity and TCCC Bottler Company] or their affiliates, their agencies, or anyone else professionally connected with the NESTEA® “Crazy Calculator”.
In order to be eligible, entrants must be 18 years of age. Winners may be requested to provide proof of identity and age.
Each entrant may only register once for the NESTEA® “Crazy Calculator”.
Registration for the NESTEA® “Crazy Calculator” is deemed to constitute acceptance of these terms and conditions and entrants agree to abide by the rules set out in these terms and conditions.
A winner of the NESTEA® “Crazy Calculator” is the entrant gaining the highest amount of solved equations within a single play at the time when the NESTEA® “Crazy Calculator” game ends.
Entrants must make their online submission in the required form with:
Nickname, e-mail, password
Agreement to the terms and conditions
Registrations through agents or clubs will not be eligible.

Entrants to the NESTEA® "Crazy Calculator” agree that all worldwide rights, title and/or interests in and to any intellectual property rights (which shall include but not be limited to copyright, entrant’s moral rights, design rights and trademarks) contained in any data or materials (including but not limited to photographs, ideas, artworks, inventions, developments, suggestions or concepts) submitted to BPW or to The Coca-Cola Company or its affiliates through the on-line NESTEA® "Crazy Calculator” or to BPW or The Coca-Cola Company or its affiliates through any other means, shall vest (with the exception of entrant’s moral rights) in BPW and the entrant hereby assigns to BPW, by way of present and future assignment, (or waives in respect of entrant’s moral rights), all such worldwide rights, title and/or interests for as long as such rights shall remain valid. If, for any reason, entrant is unable to assign ownership of any intellectual property rights to BPW, then entrant grants to BPW, a worldwide, fully paid up, irrevocable and perpetual license to use and reproduce such intellectual property rights. Such license shall be fully assignable and capable of being sublicensed without any further recourse to entrant. BPW shall be free to make, have made, use and sell any and all products utilizing these intellectual property rights assigned or licensed to BPW. The entrant further agrees to do such acts and sign such documents as will be necessary to give effect to the matters contemplated in this clause.
BPW, The Coca-Cola Company or any of their affiliates will not be liable for any loss or damage whatsoever suffered (including but not limited to direct or consequential loss) or for any personal injury suffered during the course of entering and/or participating in the NESTEA® "Crazy Calculator" and/or as a result of your access to, use, inability to use, or change in content of, this website except for any liability which cannot be excluded by law.
To the extent permitted by applicable law, neither BPW, The Coca-Cola Company or their affiliates assume any responsibility or liability for:
- Any incorrect or inaccurate data entry, or for any faulty or failed electronic data transmissions;
- Any unauthorized access to, or theft, destruction or alteration of any submitted entrant data or material at any point in the operation of NESTEA® "Crazy Calculator";
- Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the NESTEA® "Crazy Calculator";
- Inaccessibility or unavailability of the internet or the website or any combination thereof; and/or
- Non or late receipt of entrant registrations due to operator or network error.
Entrants and any other users of this website are prohibited from doing any act that BPW, The Coca-Cola Company or any of their affiliates in their reasonable discretion may deem to be inappropriate and/or would be deemed to be an unlawful act or is prohibited by laws applicable to this website including but not limited to:
- Any act that would constitute a breach of either the privacy (including uploading private information without the concerned individual’s consent) or any other of the legal rights of individuals;
- Using this website to defame or libel any individual, company or other organization including BPW, The Coca-Cola Company or any of their affiliates and/or their employees;
- Uploading files that contain viruses or equivalent that may cause damage to the property of BPW, The Coca-Cola Company or any of their affiliates or the property of other individuals; and
- Undertaking any act that would constitute unauthorized use of any of the intellectual property rights displayed in the text, images and other materials of this website including copyright, trademarks, logos, characters and service marks. Further, nothing contained on this website should be construed as granting any license or right to use any of these intellectual property rights including copyright, trademarks, logos, characters and service marks displayed on this website.
BPW reserves the right to change or expand these conditions of participation at any time, or to limit, suspend or cancel the implementation of the NESTEA® "Crazy Calculator" in the event of unforeseen circumstances.
In the event that individual clauses of these conditions of participation are held to be invalid, then the remaining clauses of these conditions of participation shall remain in force and effect.
If there is any reason to believe that there has been a breach of these terms and conditions, or in the spirit of the game of NESTEA® "Crazy Calculator", BPW in its sole discretion may refuse to make an award to that entrant. BPW will be the final arbiter in any decisions and any decision made will be final and binding and no additional correspondence will be entered into.

DATA PRIVACY CLAUSE

Provided that you have registered for the NESTEA® "Crazy Calculator" over the Internet, your personal data will be collected and electronically processed by MRM Worldwide GmbH (Zweigniederlassung Düsseldorf, Rochusstrasse 47, 40479 Düsseldorf, Germany), which will at the same time be the liable body for the collection and processing of your personal data.
Registration is only possible online. It is not possible to register for the NESTEA® "Crazy Calculator" by sending in a postcard or by telephone.
The personal data will be electronically processed and saved only for the purposes of your participation in the NESTEA® "Crazy Calculator", and only for as long as the implementation of the NESTEA® "Crazy Calculator" is required.
The personal data collected within the framework of the NESTEA® "Crazy Calculator" serves exclusively for the determination of the winner and will not be made available for any other use, in particular for third parties that are not associated with the implementation and carrying out of the NESTEA® "Crazy Calculator".

With this you agree that your personal data is allowed to be shared with the above-mentioned persons, for the aforementioned purpose of data-processing and the carrying out of the NESTEA® "Crazy Calculator".
This entire declaration of consent may at any time be cancelled with written notification to MRM Worldwide GmbH (Zweigniederlassung Düsseldorf, Rochusstrasse 47, 40479 Düsseldorf, Germany) or an e-mail to this address: info@nestea-nation.com. In the absence of the presentation of the necessary personal data for the implementation of the NESTEA® "Crazy Calculator", your participation in the NESTEA® "Crazy Calculator" will end.
McCann Erickson will, in the case of the cancellation of the declaration of consent, inform the above-mentioned persons involved in the carrying out of the NESTEA® "Crazy Calculator".
McCann Erickson points out in relation to this, that the quality of data protection in some countries where the personal data could be transmitted (the USA for example), cannot be compared to that within the EU.
